These General Terms and Conditions, as amended from time to time, are applied by Ummah Kids TV, located at Korendragershof 3, Weesp, NL43KNAB 0259414573, operating under the name Ummah Kids TV, and are an integral part of all legal relationships between the Customer and Ummah Kids TV, unless the applicability of these General Terms and Conditions is excluded or limited by applicable laws, regulations, or written agreement. Definitions For the purpose of these general terms and conditions, the following terms are designated with a capital letter. These terms are understood as follows: a) General Terms and Conditions: these general terms and conditions. b) Cooling-off Period: the period within which the Right of Withdrawal can be invoked. c) Services: collective term for all services that Ummah Kids TV is able to provide to the Customer through the Platform. d) Right of Withdrawal: the Customer's right to revoke the Agreement within the Cooling-off Period. e) Customer: a natural person who subscribes to one or more Services of Ummah Kids TV. f) Agreement: the agreement between the Customer and Ummah Kids TV regarding access to and use of the Platform. g) Platform: the interactive video platform of Ummah Kids TV accessible via URL www.ummahkidstv.com Offer If an offer has a limited validity period or is subject to conditions, this will be explicitly stated in the offer. All offers and other expressions of Ummah Kids TV are without obligation and are an invitation to subscribe to Services from Ummah Kids TV. The fact that Services are offered by Ummah Kids TV at any time does not guarantee that these Services will be offered at all times. Ummah Kids TV is entitled to change and modify the offer. Manifest errors and/or obvious mistakes in the offer do not bind Ummah Kids TV, and the Customer cannot derive any rights from such manifest errors and/or obvious mistakes.
Agreement, Services The Agreement is concluded at the moment the Customer signs up via the Platform by creating an account, and Ummah Kids TV confirms the registration. The Customer must be at least eighteen (18) years old. With each subscription to a Service by the Customer, a separate agreement between the Customer and Ummah Kids TV is concluded. Ummah Kids TV is entitled to engage third parties for the execution of the Agreement and the provision of Services. Right of Withdrawal With each Agreement, the Customer has a Cooling-off Period of fourteen (14) days during which he can revoke the Agreement without giving reasons. Ummah Kids TV may ask the Customer for the reason(s) for revocation, but the Customer is not obliged to provide his reason(s). The Cooling-off Period referred to in article 4.1 expires fourteen (14) days after the day the Agreement is concluded. In the event of exercising the Right of Withdrawal within the Cooling-off Period, the Customer owes Ummah Kids TV an amount proportionate to that part of the Agreement that has been fulfilled by Ummah Kids TV at the time of exercising the Right of Withdrawal, compared to the full performance of the Agreement. The proportionate amount that the Customer must pay to Ummah Kids TV is calculated on the basis of the total price as set out in the Agreement.
Exercise of the right of withdrawal by the customer If the Customer wishes to revoke the Agreement, the Customer must disable the automatic debit authorization in his own account environment. There will be no debit in the following month. If the Customer exercises his Right of Withdrawal, all additional agreements are automatically revoked as well. Price and Payment The prices mentioned on the Platform are in euros and inclusive of VAT and any other government-imposed levies. Payment by the Customer must be made via iDEAL, credit card, or other available payment methods, prior to subscribing to a Service, unless otherwise agreed in writing. Account and Security The Customer is obliged to provide correct and complete information when creating the account. Incorrect information must be corrected by the Customer without delay, and incomplete information must be supplemented by the Customer without delay. The Customer is responsible for the confidentiality of his account, including the login details. The Customer must immediately inform Ummah Kids TV of any unauthorized use of his customer account.
Use of the Platform The Customer is not allowed to use the Platform in such a way that it jeopardizes the functioning of the Platform and/or affects the information offered or the underlying software. The Customer is not allowed to use the Platform for purposes other than personal and non-commercial purposes. Availability of the Platform Ummah Kids TV aims to make the Platform available as much as possible. For maintenance purposes, Ummah Kids TV may temporarily disable parts of the Platform. Ummah Kids TV will minimize this and notify the Customer in a timely manner, unless this cannot reasonably be demanded from Ummah Kids TV. Third Parties Through the Platform, articles from third parties are sometimes offered. If the articles of these third parties are purchased, separate terms and conditions (from these third parties) may apply. For the use of the Platform and the subscription to Services, the software of third parties may be required, in which case separate terms and conditions (from these third parties) may apply. Amendment of the agreement Ummah Kids TV is entitled to amend the Agreement and the General Terms and Conditions interim. At least one month before a proposed change of one or more provisions of the Agreement comes into effect: a) Ummah Kids TV adequately informs the Customer of the content of the proposed changes; b) Ummah Kids TV offers the Customer the possibility to terminate the Agreement free of charge.
Liability of the Customer The Customer is liable for damage to Ummah Kids TV caused by the Customer's violation of any provision of these General Terms and Conditions. In addition, the Customer is liable for damage to Ummah Kids TV caused by intent or recklessness on the part of the Customer. The Customer indemnifies Ummah Kids TV against claims from third parties for compensation for damage they have suffered as a result of the use the Customer makes of the Platform and the Services the Customer subscribes to. Liability of Ummah Kids TV These General Terms and Conditions do not limit or exclude Ummah Kids TV's liability to the extent that it cannot be limited or excluded under applicable law. Ummah Kids TV is not liable for damage caused by the Customer's violation of any provision of these General Terms and Conditions. Ummah Kids TV is not liable for indirect damage, in any form. If the Customer purchases an article from a third party via the Platform, for which this third party must have personal data, then Ummah Kids TV is not liable for damage caused by the processing of personal data by this third party. In any case, the liability of Ummah Kids TV is limited to the amount that Ummah Kids TV's insurer pays in the relevant case.
Force Majeure The Customer and Ummah Kids TV shall not be liable for any delay or non-performance, directly or indirectly, as a result of force majeure. Force majeure shall in any case include disruptions in internet connection, disruptions in the telecommunication infrastructure, disruptions in networks, and disruptions resulting from unlawful acts of third parties. Intellectual Property Rights The intellectual property rights regarding the Platform and its content belong to Ummah Kids TV, unless otherwise stated. The Customer is not allowed to reproduce, store in an automated database, or disclose anything from the platform in any form or manner, whether electronically, by photocopying, recordings, or in any other way, without prior written consent from Ummah Kids TV, except for news articles and content that can be shared via social media on the Platform. Transfer of Rights The Customer is not entitled to sell or transfer his rights and/or obligations from the Agreement to any third party, unless otherwise agreed upon in writing. Ummah Kids TV is entitled to sell or transfer its rights and/or obligations from the Agreement without the consent of the Customer. Invalid Provisions If at any time a provision of these General Terms and Conditions is wholly or partially invalid, unenforceable, or impracticable under the applicable laws and/or regulations, the remaining (parts of) provisions of these General Terms and Conditions shall remain in force. The relevant provision shall be replaced by an enforceable and practicable provision that, given the purpose and scope of these General Terms and Conditions, deviates as little as possible from the original provision.
